These Terms of Use (“Terms”) set out the terms and conditions for use of the Achievers Circle Private Limited (“Achievers”, “we”, “us”, “our”) platform, which includes www.achieverscircle.org, www.achieversclassesexams.com, and any associated content, forums, or services (collectively, the “Platform”).

These Terms apply to all end users of the Platform (“Learners”, “You”, “Your”). By accessing or using our Platform, you agree to be bound by these Terms, our Privacy Policy, and any other policies posted on our Platform (together, the “Agreement”). If you do not agree, please do not use the Platform.

1. Access and Registration
   
   a. You must be at least 18 years old, or if you are between 13 and 18, you must have parental or guardian consent to use the Platform. If you are under 13, you may not use our Platform.

   a. You are granted a limited, non-exclusive license to access and view Content for your personal, non-commercial use only.
   b. You may not:
   1. Modify, copy, or create derivative works from the Content or any Platform material.
   2. Use Content for commercial purposes, publicly display, or distribute without written permission.
   3. Decompile, reverse engineer, or otherwise attempt to extract source code from any software on the Platform.
   4. Remove copyright or proprietary notices from Content or Platform material.
   5. Transfer Content to another person or “mirror” Content on another server.
   c. This license terminates automatically if you violate any Terms.
3. Communications & Forums
   
   a. The Platform may offer discussion forums (“Public Forums”) for sharing knowledge and communication with other users. Participation is optional.
   b. You are solely responsible for anything you post (“Learner Content”). By posting, you grant us a perpetual, worldwide, royalty-free license to use, display, and distribute your content in connection with the Platform.
   c. We reserve the right to remove any content or restrict access at any time for violations.
4. Code of Conduct
   1. You agree to use the Platform only for lawful purposes and not violate any applicable laws or regulations.
   2. No harmful, violent, hateful, defamatory, harassing, bullying, or otherwise objectionable content may be posted.
   3. No spamming, scams, impersonation, privacy violations, or uploading of malware is permitted.

5. Intellectual Property

   If you submit suggestions, comments, or ideas (“Feedback”), we may use them without any compensation to you.
7. Payments & Refunds
   To access paid content, you may need to pay a fee (“Content Fee”). Payments are processed via secure third-party providers; we do not store your payment details.
   
   All purchases made on our Platform are final and non-refundable. Once you enroll or make a payment for any course, exam, service, or product (digital or physical), no refunds will be issued under any circumstances, except as required by law or as specifically stated in a particular offer.

8. Disclaimer
   The Platform and all services/content are provided “as is” without warranties of any kind. Achievers does not guarantee uninterrupted service, accuracy, or fitness for any purpose. Your use is at your own risk.
9. Limitation of Liability
   Achievers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Platform or any Content.
10. Indemnity
    You agree to indemnify and hold harmless Achievers, its officers, directors, agents, and employees from any claims, damages, or liabilities arising out of your breach of these Terms or violation of laws/rights of others.
11. Links to Third-Party Websites
    The Platform may link to external sites. We do not endorse or assume responsibility for their content or practices. Your use of any linked site is at your own risk.
12. Governing Law & Jurisdiction
    These Terms are governed by Indian law. You agree to submit to the exclusive jurisdiction of the courts located in Kolkata, India.
13. Miscellaneous
    1. We may update these Terms at any time. Continued use means acceptance of changes.
    2. If any provision is found unenforceable, the rest will remain in effect.
    3. Our failure to enforce any right is not a waiver of that right.
    4. You may not transfer your rights under these Terms to anyone else.
    5. We are not responsible for delays or failures caused by events beyond our control.
